Who Owns Your Leads and Ad Data When You Use a Real Estate Marketing Agency?

By James Todman, Founder of AgentHype. Updated October 2026.

The short answer

You should. Every lead, every audience and every piece of ad data built from your marketing should belong to you, and stay with you if you ever stop working with the agency. At AgentHype, campaigns run in your own ad account, leads are delivered to you and your CRM, and we do not share your data.

Why this question matters

Every time a homeowner watches your video, clicks your ad or visits your landing page, your ad account learns something. Over months, that becomes a valuable retargeting audience of local owners who know your name. If the campaigns run in an agency's ad account instead of yours, that audience belongs to them. When you leave, it leaves with them, and you start again from zero.

How AgentHype handles it

  • Your ad account. We run every campaign inside your own Meta ad account through partner access. You can log in and see every ad, every result and every dollar at any time.
  • Your leads. Leads are delivered to you by text and email, into Google Sheets, into the AgentHype provided CRM and into your own CRM if you use one.
  • Your data stays yours. If you ever stop working with us, the leads and the ad account data are still yours. We do not take them.
  • No sharing. We do not share your data or results with other agents.

How privacy consent works

Privacy rules have tightened in both Australia and New Zealand, and agents are right to ask how lead data is collected. On every AgentHype landing page, the homeowner must actively tick an unchecked consent box, linked to the full privacy policy and terms, before they can submit. That consent covers being contacted by the agent and seeing related marketing. Our policies were rewritten when the rules changed in both countries.

Follow up also respects local rules. In Australia, leads receive SMS and email follow up. In New Zealand, follow up is by email only.

What about your existing database?

Your own database can be uploaded to Meta as a custom audience, so past clients see your ads without receiving another email or call. It is one of the best ways to stay visible to people who already trust you. Only use data you are entitled to use, and check any restraint or agreement with a previous agency before you do.

Questions to ask any agency

  • Which ad account will my campaigns run in?
  • If I leave, what do I keep?
  • Where do my leads go, and how quickly?
  • How is consent collected on your forms?
  • Do you share my data or results with anyone?

The bottom line

Marketing builds an asset. Make sure it is yours. Before you sign with any agency, ask where the ads run and what you keep if you part ways.
